                             SUMMARY

The following summary is not prepared by the sponsors of the

introduced.

  Eliminates requirement for special relationship to establish
liability of local government for economic injuries incurred by
person acting in good faith reliance on negligent
misrepresentation by local government of effect of comprehensive
plan and land use regulations.

                        A BILL FOR AN ACT
Relating to tort liability for land use errors by public body.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2013 Act is added to and made
a part of ORS chapter 195. + }
  SECTION 2.  { + (1) A local government is liable in tort under
ORS 30.260 to 30.300 for the economic injuries incurred by a
person who acts in good faith reliance on the negligent
misrepresentations of a local government regarding the effect of
the local government's comprehensive plan, and land use
regulations implementing the plan, on the private real property
of the person.
  (2) A special relationship is not required under subsection (1)
of this section. + }
