                             SUMMARY

The following summary is not prepared by the sponsors of the

brief statement of the essential features of the measure as
introduced.

  Requires Director of Department of Consumer and Business
Services to prescribe pilot program in which small employer
groups offer healthy behavior dividends that are exempt from rate
variation requirements.
  Sunsets January 2, 2016.
  Declares emergency, effective on passage.

                        A BILL FOR AN ACT
Relating to health benefit plans offering dividends for healthy
  behaviors; and declaring an emergency.
Be It Enacted by the People of the State of Oregon:
  SECTION 1.  { + Section 2 of this 2010 Act is added to and made
a part of the Insurance Code. + }
  SECTION 2.  { + (1) To the extent permitted by federal law, the
Director of the Department of Consumer and Business Services
shall prescribe by rule a pilot program to operate within a
distinct geographic region of this state that meets the following
criteria:
  (a) Carriers offer health benefit plans to small employer
groups located within the pilot program region that pay dividends
for healthy behaviors in accordance with ORS 743.824.
  (b) The combined total of all employees participating in the
plans operating within the pilot program shall be no less than
1,000.
  (2) Dividends paid by insurers to participants in the pilot
program under subsection (1) of this section are not premium
variations for the purposes of ORS 743.737 (8).
  (3) The director shall evaluate the pilot program and report to
the Legislative Assembly no later than October 1, 2012, on the
effectiveness of the pilot program in encouraging small employer
groups to offer plans that pay healthy behavior dividends.
  (4) The director shall conduct a final evaluation of the pilot
program and make recommendations to the Legislative Assembly no
later than October 1, 2014. + }
  SECTION 3.  { + Section 2 of this 2010 Act is repealed January
2, 2016. + }
  SECTION 4.  { + This 2010 Act being necessary for the immediate
preservation of the public peace, health and safety, an emergency
is declared to exist, and this 2010 Act takes effect on its
passage. + }
