AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

Consolidated Statutes, further providing for exceptions to

3

prohibition of interception and disclosure of communications.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

Section 1.  Section 5704(4) of Title 18 of the Pennsylvania

7

Consolidated Statutes is amended to read:

8

§ 5704.  Exceptions to prohibition of interception and

9

disclosure of communications.

10

It shall not be unlawful and no prior court approval shall be

11

required under this chapter for:

(4)  A person, to intercept a wire, electronic or oral

14

communication, where [all parties to the communication have

15

given prior consent to such interception] the person is a

16

party to the communication or where one of the parties to the

17

communication has given prior consent to the interception

18

unless the communication is intercepted for the purpose of

committing any criminal or tortious act.

Section 2.  This act shall take effect in 60 days.
