AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, further providing for 

3

sentencing and for contents of presentence report; and 

4

imposing duties on the Secretary of the Commonwealth.

The General Assembly of the Commonwealth of Pennsylvania

6

hereby enacts as follows:

Section 1.  Section 9721 of Title 42 of the Pennsylvania

8

Consolidated Statutes is amended by adding a subsection to read:

9

§ 9721.  Sentencing generally.

(f)  Voter registration.--The following shall apply:

12

(1)  In every case where the court imposes a sentence

13

with confinement for a felony and the defendant is a

14

registrant, the court shall make a part of the record, and

15

disclose in open court at the time of sentencing, an order

canceling the registration of the defendant and directing the

2

commission in the county of registration of the defendant to

3

remove the defendant from the general register of the county.

(2)  As used in this subsection, the following words and

5

phrases shall have the meanings given to them in this

6

paragraph:

7

"Commission."  As defined in 25 Pa.C.S. § 1102 (relating

8

to definitions).

9

"General register."  As defined in 25 Pa.C.S. § 1102

10

(relating to definitions).

11

"Registrant."  As defined in 25 Pa.C.S. § 1102 (relating

12

to definitions).

Section 2.  Section 9732 of Title 42 is amended to read:

14

§ 9732.  Contents of presentence report.

15

The presentence report shall include [a summary of the

16

circumstances attending the commission of the crime, the history

17

of delinquency or criminality, physical and mental condition,

18

family situation and background, economic status, education,

19

occupation and personal habits of the defendant, any history of

20

drug or alcohol abuse or addiction and any other matters that

21

the person preparing the report deems relevant or that the court

22

directs be included] all of the following:

23

(1)  A summary of the circumstances attending the

24

commission of the crime.

25

(2)  The history of delinquency or criminality of the

26

defendant.

27

(3)  The physical and mental health of the defendant.

28

(4)  The family background and current family situation

29

of the defendant.

(5)  The economic status, education and occupation of the

defendant.

(6)  The personal habits of the defendant.

3

(7)  Any history of drug or alcohol abuse or addiction of

4

the defendant.

5

(8)  If the defendant was convicted of a felony, whether

6

the defendant is registered to vote under 25 Pa.C.S. Pt. IV

7

(relating to voter registration) and if so in what county.

8

(9)  Any other matter that the person preparing the

9

report deems relevant or that the court directs be included.

Section 3.  Upon enactment of this legislation, the Secretary

11

of the Commonwealth shall notify, and transfer a copy of this

12

act to, the Court Administrator of Pennsylvania and to the

13

chairman of the Criminal Procedural Rules Committee requesting

14

that the committee amend the Pennsylvania Rules of Criminal

15

Procedure to be consistent with this act.

16

Section 4.  This act shall take effect in 30 days.
