AN ACT

  

1

Amending the act of March 10, 1949 (P.L.30, No.14), entitled "An

2

act relating to the public school system, including certain

3

provisions applicable as well to private and parochial

4

schools; amending, revising, consolidating and changing the

5

laws relating thereto," further providing for funding for

6

charter schools and for annual reports and assessments.

7

The General Assembly of the Commonwealth of Pennsylvania

8

hereby enacts as follows:

9

Section 1.  Section 1725-A(a) of the act of March 10, 1949

10

(P.L.30, No.14), known as the Public School Code of 1949,

11

amended June 29, 2002 (P.L.524, No.88), is amended to read:

12

Section 1725-A.  Funding for Charter Schools.--(a)  Funding

13

for a charter school shall be provided in the following manner:

14

(1)  There shall be no tuition charge for a resident or

15

nonresident student attending a charter school.

16

(1.1)  For the 2009-2010 school year and each school year

17

thereafter, the department shall establish a cyber education

18

actual cost level and a cyber special education actual cost

19

level as follows:

(i)  The department shall establish the cyber education

2

actual cost level for the 2009-2010 school year by determining

3

the lowest 2007-2008 total expenditures per average daily

4

membership, after having subtracted all expenditures for special

5

education, of all cyber charter schools that achieved adequate

6

yearly progress in the 2006-2007 or 2007-2008 school years. The

7

amount shall be certified by the department and adjusted

8

annually by the percentage increase in the average of the

9

Statewide average weekly wage and the employment cost index.

10

(ii)  The department shall establish the cyber special

11

education actual cost level for the 2009-2010 school year by

12

calculating the sum of the amount determined under subparagraph

13

(i) and the lowest 2007-2008 expenditures for special education

14

per special education student of all cyber charter schools that

15

achieved adequate yearly progress in the 2006-2007 or 2007-2008

16

school years. The amount shall be certified by the department

17

and adjusted annually by the percentage increase in the average

18

of the Statewide average weekly wage and the employment cost

19

index.

(2)  (i)  For non-special education students enrolled in a

21

charter school that is not a cyber charter school, the charter

22

school shall receive for each student enrolled no less than the

23

budgeted total expenditure per average daily membership of the

24

prior school year, as defined in section 2501(20), minus the

25

budgeted expenditures of the district of residence for nonpublic

26

school programs; adult education programs; community/junior

27

college programs; student transportation services; for special

28

education programs; facilities acquisition, construction and

29

improvement services; and other financing uses, including debt

30

service and fund transfers as provided in the Manual of

School Systems established by the department. This amount shall

3

be paid by the district of residence of each student[.] or, upon

4

written request of the charter school, by the department to the

5

charter school in which a Pennsylvania resident student is

6

enrolled from any allocation for basic education funding to

7

which the school district in which the student resides is

8

entitled. The department shall establish payment guidelines and

9

notify the school district of receipt of a request for direct

10

payment by the department.

11

(ii)  (A)  In the 2009-2010 school year and each school year

12

thereafter, for non-special education students enrolled in a

13

cyber charter school, the cyber charter school shall receive for

14

each student enrolled the lesser of:

15

(I)  An amount equal to the cyber education actual cost

16

level.

17

(II)  The amount determined under subparagraph (i).

18

(B)  The amount under this subparagraph shall be paid by the

19

district of residence of each student or, upon written request

20

of the charter school, by the department to the charter school

21

in which a Pennsylvania resident student is enrolled from any

22

allocation for basic education funding to which the school

23

district in which the student resides is entitled. The

24

department shall establish payment guidelines and notify the

25

school district of the receipt of a request for direct payment

26

by the department.

(3)  (i)  For special education students enrolled in a

28

charter school that is not a cyber charter school, the charter

29

school shall receive for each student enrolled the same funding

30

as for each non-special education student as provided in clause

(2), plus an additional amount determined by dividing the

2

district of residence's total special education expenditure by

3

the product of multiplying the combined percentage of section

4

2509.5(k) times the district of residence's total average daily

5

membership for the prior school year, except that, for students

6

identified as speech or language impaired, the charter shall

7

receive for each student twenty per centum of the additional

8

amount calculated under this subsection. This amount shall be

9

paid by the district of residence of each student or, upon

10

written request of the charter school, by the department to the

11

charter school in which a Pennsylvania resident student is

12

enrolled from any allocation for basic education funding to

13

which the school district in which the student resides is

14

entitled. The department shall establish payment guidelines and

15

notify the school district of the receipt of a request for

16

direct payment by the department.

(ii)  (A)  In the 2009-2010 school year and each school year

18

thereafter, for special education students enrolled in a cyber

19

charter school, the cyber charter school shall receive for each

20

student enrolled the lesser of:

21

(I)  An amount equal to the cost of the cyber special

22

education actual cost level.

23

(II)  The amount determined under subclause (i).

24

(B)  The amount under this subclause shall be paid by the

25

district of residence of each student or, upon written request

26

of the charter school, by the department to the charter school

27

in which a Pennsylvania resident student is enrolled from any

28

allocation for basic education funding to which the school

29

district in which the student resides is entitled. The

30

department shall establish payment guidelines and notify the

school district of the receipt of a request for direct payment

2

by the department.

(iii)  No later than November 15, 2009, and November 15 of

4

each year thereafter, if in any charter school the total actual

5

special education expenses for the prior school year are less

6

than the total special education payments made for that school

7

year by all school entities based on the result of an

8

independently audited annual financial report submitted by the

9

charter school to the department, the difference shall be

10

distributed to the school entities with students enrolled in the

11

charter school in the prior school year in proportion to the

12

number of students in average daily membership from each school

13

entity and each school's per pupil payment level under clause

14

(3).

15

(4)  A charter school may request the intermediate unit in

16

which the charter school is located to provide services to

17

assist the charter school to address the specific needs of

18

exceptional students. The intermediate unit shall assist the

19

charter school and bill the charter school for the services. The

20

intermediate unit may not charge the charter school more for any

21

service than it charges the constituent districts of the

22

intermediate unit.

23

(5)  Payments shall be made to the charter school in twelve

24

(12) equal monthly payments, by the fifth day of each month,

25

within the operating school year, unless the charter school

26

receives direct payment from the department. A student enrolled

27

in a charter school shall be included in the average daily

28

membership of the student's district of residence for the

29

purpose of providing basic education funding payments and

30

special education funding pursuant to Article XXV. If a school

district fails to make a payment to a charter school as

2

prescribed in this clause, the secretary shall deduct the

3

estimated amount, as documented by the charter school, from any

4

and all State payments made to the district after receipt of

5

documentation from the charter school.

(6)  Within thirty (30) days after the secretary makes the

7

deduction described in clause (5) or if the charter school

8

receives direct payment from the department, a school district

9

may notify the secretary that the deduction made from State

10

payments to the district under this subsection is inaccurate.

11

The secretary shall provide the school district with an

12

opportunity to be heard concerning whether the charter school

13

documented that its students were enrolled in the charter

14

school, the period of time during which each student was

15

enrolled, the school district of residence of each student and

16

whether the amounts deducted from the school district were

17

accurate.

18

(7)  (i)  For the 2009-2010 school year and each school year

19

thereafter, no cyber charter school shall accumulate an

20

unreserved, undesignated fund balance greater than the cyber

21

charter fund balance limit, which shall be determined as

22

follows:

(ii)  Any unreserved, undesignated fund balance in place on

10

June 30, 2009, that exceeds the cyber charter fund balance limit

11

shall be distributed by the cyber charter school as follows:

12

(A)  The cyber charter school may expend up to forty per

13

centum of the fund balance in excess of the limit, but no more

14

than $1,000,000, on professional development, student supplies,

15

technology, instructional activities directly affecting student

16

performance, to provide a discount to the cyber education actual

17

cost level and cyber special education actual cost level to all

18

school districts on behalf of enrolled students or other

19

activities as approved by the secretary upon application by the

20

cyber charter school. The funds may not be used to pay bonuses

21

to any employe or contractor.

22

(B)  The remainder shall be refunded on a pro rata basis

23

within ninety (90) days to all school districts that paid

24

tuition to the cyber charter school on behalf of students

25

enrolled in the 2007-2008 and 2008-2009 school years.

26

(iii)  For the 2009-2010 school year and each school year

27

thereafter, any unreserved, undesignated fund balance in excess

28

of the cyber charter fund balance limit shall be refunded on a

29

pro rata basis to all school districts that paid tuition to the

30

cyber charter school in the prior school year.

(8)  Except in the case of any student enrolled in a cyber

2

charter school on the effective date of this clause, a school

3

district shall not be required to provide per pupil funding to

4

cyber charter schools for a student who does not meet the

5

minimum requirement for the age of kindergarten or beginner

6

established by the board of school directors in the student's

7

school district of residence. The term "beginners," as used in

8

this clause, shall mean any child that should enter the lowest

9

grade of the primary school or the lowest primary class above

10

the kindergarten level.

11

(9)  If a student's school district of residence does not

12

offer full-day kindergarten, the school district of residence

13

shall only be required to pay a cyber charter school one-half of

14

the amount calculated under clause (2)(ii) or (3)(ii) for any

15

student who is enrolled in kindergarten in a cyber charter

16

school.

Section 2.  Section 1728-A of the act is amended by adding a

19

subsection to read:

20

Section 1728-A.  Annual Reports and Assessments.--* * *

21

(d)  The department shall publish an annual report that does

22

all of the following:

23

(1)  Identifies charter schools whose students are

24

academically out-performing comparable students enrolled in the

25

chartering school district.

26

(2)  Describes best practices used in the charter schools

27

identified under clause (1) that should be disseminated to all

28

school districts and charter schools.

(3)  Makes any necessary recommendations to the General

30

Assembly to further the dissemination and implementation of the

best practices identified under clause (2).

Section 3.  This act shall take effect July 1, 2009, or

3

immediately, whichever is later.
