AN ACT

Amending Title 42 (Judiciary and Judicial Procedure) of the

2

Pennsylvania Consolidated Statutes, providing for

3

Pennsylvania State Police Training Account.

The General Assembly of the Commonwealth of Pennsylvania

5

hereby enacts as follows:

6

Section 1.  Title 42 of the Pennsylvania Consolidated

7

Statutes is amended by adding a section to read:

8

§ 3576.  Pennsylvania State Police Training Account.

9

(a)  Establishment of account.--There is hereby established

10

within the General Fund a restricted receipt account to be known

11

as the Pennsylvania State Police Training Account.

12

(b)  Additional fees.--In addition to the court costs and

13

filing fees authorized to be collected by statute, an additional

14

fee of $10 shall be charged and collected by the clerk of courts

15

of all courts of common pleas, or by any official designated to

16

perform the functions thereof, and by the minor judiciary,

17

including the magisterial district judges, Philadelphia

18

Municipal Court, Philadelphia Traffic Court and Pittsburgh

19

Magistrates Court, in a legal proceeding in which a person is

found guilty of, or pleads guilty or nolo contendre to, an

2

offense under 75 Pa.C.S. (relating to vehicles).

(c)  Transfer of additional fees.--The fees charged and

4

collected under subsection (b) shall be paid to the court

5

imposing the fee which shall transfer the moneys to the

6

Department of Revenue for deposit into the Pennsylvania State

7

Police Training Account.

(d)  Utilization of funds in account.--All money deposited

9

into the Pennsylvania State Police Training Account shall be

10

used only for recruiting, hiring, training and equipping police

11

cadets.

(e)  Annual appropriations.--Beginning with fiscal year

13

2009-2010, the General Assembly shall appropriate from the

14

Pennsylvania State Police Training Account funds sufficient to

15

meet the costs of recruiting, hiring, training and equipping

16

Pennsylvania State Police cadets until such time as the

17

aggregate number of Pennsylvania State Police members is the

18

maximum number as authorized by the act of December 13, 2001

19

(P.L.903, No.100).

20

Section 2.  This act shall take effect in 60 days.
