AN ACT

  

1

Requiring proper maintenance of abandoned businesses in cities;

2

establishing the Abandoned Business Facilities Fund;

3

conferring powers and duties on the Department of Community

4

and Economic Development; and providing for penalties and

5

remedies.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Short title.

9

This act shall be known and may be cited as the Abandoned

10

Business Facilities Act.

11

Section 2.  Definitions.

12

The following words and phrases when used in this act shall

13

have the meanings given to them in this section unless the

14

context clearly indicates otherwise:

15

"Business facility."  A parcel of real property and

16

improvements on the property which are:

17

(1)  located in a city, township or borough; and

18

(2)  utilized as a business which is open to the public.

19

"City."  A city of the first, second, second class A or third

class. The term includes a borough with a population large

2

enough for the borough to qualify to be chartered as a city

3

under provisions for a charter as a city separately from any

4

town, township or other borough under section 201 of the act of

5

June 23, 1931 (P.L.932, No.317), known as The Third Class City

6

Code.

7

"Department."  The Department of Community and Economic

8

Development of the Commonwealth.

9

"Fund."  The Abandoned Business Facilities Fund established

10

in section 4.

Section 3.  Department.

12

The department has the following powers and duties:

13

(1)  Administer this act.

14

(2)  Utilize the fund under section 4(c).

15

(3)  Promulgate regulations under section 5(a)(1).

16

(4)  Approve transfers under section 5(a)(2).

17

(5)  Impose penalties under section 5(b).

18

(6)  Seek injunctive relief under section 5(c).

19

Section 4.  Fund.

20

(a)  Establishment.--The Abandoned Business Facilities Fund

21

is established as a separate fund in the State Treasury.

22

(b)  Sources.--The sources of the fund are as follows:

23

(1)  Penalties under section 5(b).

24

(2)  Appropriations.

25

(3)  Earnings on the money in the fund.

26

(c)  Purpose.--The department shall utilize the fund to do

27

all of the following:

28

(1)  Maintain abandoned businesses which are not being

29

properly maintained.

30

(2)  Administer this act. No more than 10% of the money

in the fund may be used under this paragraph during any

2

fiscal year.

(d)  Continuous appropriation.--The money in the fund is

4

appropriated on a continuing basis to the department and shall

5

not lapse at the end of any fiscal year.

Section 5.  Abandoned business facilities.

7

(a)  Requirement.--If a business facility ceases operation,

8

the owner of the business facility shall do one of the

9

following:

10

(1)  Maintain the business facility to standards of

11

health and safety established by regulations of the

12

department, including lighting and sanitation.

13

(2)  Transfer the business facility to a community group

14

approved by the department at a nominal consideration.

15

(b)  Penalty.--

16

(1)  An owner that violates subsection (a) is subject to

17

an administrative penalty of $10,000. Each day of violation

18

of subsection (a)(1) constitutes a separate violation.

19

(2)  This subsection is subject to 2 Pa.C.S. Ch. 5 Subch.

20

A (relating to practice and procedure of Commonwealth

21

agencies) and Ch. 7 Subch. A (relating to judicial review of

22

Commonwealth agency action).

23

(c)  Injunction.--

24

(1)  A court may order a transfer under subsection(a)(2)

25

if it is established that the penalty under subsection (b) is

26

inadequate to maintain the abandoned business facility in

27

accordance with subsection (a)(1).

(2)  A private citizen may bring an action under this

29

subsection.

Section 6.  Effective date.

This act shall take effect as follows:

2

(1)  The following provisions shall take effect

3

immediately:

4

(i)  Section 2.

5

(ii)  Section 3(3).

6

(iii)  This section.

7

(2)  Section 5 shall take effect on the effective date of

8

the regulations promulgated under section 3(3).

9

(3)  The remainder of this act shall take effect in 60

10

days.
