AN ACT

Prohibiting the use of polyvinyl chloride pipe for water and

2

sewage transmission in certain buildings.

The General Assembly of the Commonwealth of Pennsylvania

4

hereby enacts as follows:

5

Section 1.  Short title.

6

This act shall be known and may be cited as the PVC Pipe

7

Prohibition Act.

8

Section 2.  Definitions.

9

The following words and phrases when used in this act shall

10

have the meanings given to them in this section unless the

11

context clearly indicates otherwise:

12

"PVC pipe."  Pipe made from a plastic and vinyl combination

13

material, also known as polyvinyl chloride, commonly used for

14

the transmission of water and sewage in buildings.

15

Section 3.  PVC pipe use prohibited.

16

Polyvinyl chloride, or PVC, pipe may not be used in the

17

following buildings constructed after the effective date of this

18

act:

 


1

(1)  Residential buildings that are more than three

2

stories in height.

3

(2)  Residential buildings that contain five or more

4

separate family units.

5

(3)  Structures used for commercial purposes.

6

(4)  Structures used for industrial purposes.

7

Section 4.  Existing use.

8

Residential buildings and commercial and industrial

9

structures that use PVC pipe before the effective date of this

10

act are exempt from its provisions.

11

Section 5.  Penalty.

12

A contractor that builds or remodels in violation of the

13

provisions of section 3 is subject to a fine of $3,000.

14

Section 6.  Effective date.

15

This act shall take effect in 180 days.
