A RESOLUTION

Urging Federal implementation of the John R. Justice Prosecutors

2

and Defenders Incentive Act of 2008.

WHEREAS, President George W. Bush signed into law the John R.

4

Justice Prosecutors and Defenders Incentive Act of 2008 as Title

5

IX Pt. E of the Higher Education Opportunity Act (Public Law

6

110-315, 122 Stat. 3470), establishing a student loan repayment

7

assistance program for eligible prosecutors and public

8

defenders; and

9

WHEREAS, This new program authorizes the Attorney General of

10

the United States to assume the obligation to repay up to

11

$10,000 per year and $60,000 total in student loans for

12

borrowers who agree to remain employed, for at least three

13

years, as either state or local criminal prosecutors or as

14

Federal, state or local public defenders in criminal cases, with

15

priority given to borrowers who have the least ability to repay

16

their loans; and

17

WHEREAS, At this moment in time, while President Barack Obama

is making a national appeal to our citizens to choose public

2

service, we should do everything in our power to encourage the

3

best and the brightest attorneys to serve their communities and

4

their nation as prosecutors and public defenders to both help

5

fight crime and to protect the rights of the accused; and

6

WHEREAS, All too often the financial realities that new

7

lawyers face after earning a law degree, such as student loans,

8

prevent them from pursuing these career paths, especially in

9

light of the fact that the average salary of a prosecutor is

10

less than half of the starting salary for an attorney at a large

11

private law firm; and

12

WHEREAS, Before this program can be implemented and begin

13

accepting applications, Congress must appropriate funds, the

14

President must allocate funds and the Attorney General of the

15

United States must promulgate regulations; therefore be it

16

RESOLVED, That the House of Representatives of the

17

Commonwealth of Pennsylvania urge Congress and the President of

18

the United States to appropriate and allocate an appropriate

19

level of funds and urge the Attorney General of the United

20

States to promulgate regulations to implement Title IX Pt. E of

21

the Higher Education Opportunity Act; and be it further

22

RESOLVED, That copies of this resolution be transmitted to

23

the presiding officers of each house of Congress, to each member

24

of Congress from Pennsylvania and to the President of the United

25

States.
