AN ACT

Amending Title 18 (Crimes and Offenses) of the Pennsylvania

2

Consolidated Statutes, in firearms and other dangerous

3

articles, further providing for registration of firearms; and

4

providing for mandatory registration of firearms in cities of

5

the first class and for transfer of firearms.

The General Assembly of the Commonwealth of Pennsylvania

7

hereby enacts as follows:

8

Section 1.  Section 6111.4 of Title 18 of the Pennsylvania

9

Consolidated Statutes is amended to read:

10

§ 6111.4.  Registration of firearms.

11

[Notwithstanding any section of this chapter to the

12

contrary,] Except as provided in section 6111.6 (relating to

13

mandatory registration of firearms in cities of the first

14

class), nothing in this chapter shall be construed to allow any

15

government or law enforcement agency or any agent thereof to

16

create, maintain or operate any registry of firearm ownership

17

within this Commonwealth. For the purposes of this section only,

18

the term "firearm" shall include any weapon that is designed to

19

or may readily be converted to expel any projectile by the

action of an explosive or the frame or receiver of any such

2

weapon.

Section 2.  Title 18 is amended by adding sections to read:

4

§ 6111.6.  Mandatory registration of firearms in cities of the

5

first class.

6

(a)  Registration.--Every person who is a resident of a city

7

of the first class and acquires a firearm shall register the

8

firearm with the Pennsylvania State Police in the manner

9

prescribed by this section within five days of acquisition.

10

(b)  Contents of registration form.--The registration shall

11

be on a uniform form prescribed by the Attorney General and

12

shall include the following information:

13

(1)  Name and permanent address of the owner.

14

(2)  Name of the manufacturer and importer.

15

(3)  Model.

16

(4)  Type of action.

17

(5)  Caliber or gauge.

18

(6)  Serial number.

19

(7)  Source from which the acquisition occurred,

20

including the name and address of the prior registrant.

21

(8)  If the firearm has no serial number, the permit

22

number shall be entered in the space provided for the serial

23

number, and the permit number shall be engraved on the

24

receiver portion of the firearm prior to registration.

25

(c)  Confidentiality of information.--Registration data that

26

would identify the individual registering the firearm by name or

27

address shall be confidential and shall not be disclosed to

28

anyone, except as may be required for processing the

29

registration or as may be required by a law enforcement agency

30

for the lawful performance of its duties or as may be required

by order of a court.

(d)  Exemptions.--Registration shall not be required for:

3

(1)  Any firearm manufactured on or before 1898.

4

(2)  Any firearm with a matchlock, flintlock or

5

percussion cap type of ignition system.

6

(3)  Any replica of any firearm described in paragraph

7

(1) if the replica either:

8

(i)  is not designed or redesigned to use rimfire or

9

conventional center fire fixed ammunition; or

10

(ii)  uses rimfire or conventional center fire fixed

11

ammunition which is no longer manufactured in the United

12

States and which is not readily available in the ordinary

13

channels of commercial trade.

14

(e)  Registration fee.--No fee shall be charged for the

15

registration.

16

(f)  Penalty.--A resident of a city of the first class who

17

fails to register a firearm as required under this section

18

commits a misdemeanor of the first degree.

§ 6111.7.  Transfer of firearms.

20

(a)  Duty of transferor.--In all cases where a firearm is

21

acquired from another person within this Commonwealth, other

22

than a transfer that occurs under section 6111 (relating to sale

23

or transfer of firearms), the person who transfers title to the

24

firearm shall submit to the Pennsylvania State Police, within 48

25

hours after transferring the firearm, the following information

26

in writing:

27

(1)  Name and permanent address of the person who

28

transferred the firearm.

29

(2)  Name and permanent address of the person to whom the

30

title to the firearm was transferred.

(3)  Names of the manufacturer and importer.

2

(4)  Model.

3

(5)  Type of action.

4

(6)  Caliber or gauge.

5

(7)  Serial number as applicable.

(b)  Duty of transferee.--Any person who acquires a firearm

7

pursuant to subsection (a) shall be subject to section 6111.6

8

(relating to mandatory registration of firearms in cities of the

9

first class).

10

(c)  Penalty.--Any person who fails to comply with this

11

section commits a misdemeanor of the third degree.

12

Section 3.  This act shall take effect in 60 days.
