| A RESOLUTION |
| |
1 | Honoring the life and work of Chief Justice Ralph J. Cappy for |
2 | his great and illustrious service to this Commonwealth and |
3 | contributions to the law. |
4 | WHEREAS, Ralph J. Cappy was born on August 25, 1943, to the |
5 | late Catherine Miljus Cappy and Joseph R. Cappy; and |
6 | WHEREAS, Chief Justice Cappy earned his bachelor's degree |
7 | from the University of Pittsburgh and his juris doctorate from |
8 | the University of Pittsburgh School of Law in 1965 and 1968, |
9 | respectively; and |
10 | WHEREAS, Upon graduating from the University of Pittsburgh |
11 | School of Law, Chief Justice Cappy served as law clerk to the |
12 | Allegheny County Court of Common Pleas President Judge Henry |
13 | Ellebogen before entering the general practice of law, and he |
14 | later served as an Allegheny County public defender and was |
15 | elevated to chief public defender; and |

1 | WHEREAS, Chief Justice Cappy began what was to become a |
2 | 30-year career on the bench in 1978, when Governor Milton J. |
3 | Shapp appointed him a judge of the Court of Common Pleas of |
4 | Allegheny County; and |
5 | WHEREAS, In 1979, Chief Justice Cappy was elected to serve a |
6 | full term as a judge of the court of common pleas, where he |
7 | served in the family, criminal and civil divisions; and |
8 | WHEREAS, In 1986, Chief Justice Cappy was appointed by the |
9 | Supreme Court as administrative judge of the Civil Division, |
10 | where he served until 1990; and |
11 | WHEREAS, In 1989, Chief Justice Cappy was elected to the |
12 | Pennsylvania Supreme Court, which is the highest court of the |
13 | Commonwealth, and he was retained to the position of justice of |
14 | the Supreme Court in 1999; and |
15 | WHEREAS, In January 2003, Chief Justice Cappy became the 56th |
16 | Chief Justice of Pennsylvania; and |
17 | WHEREAS, During his tenure on the Supreme Court, Chief |
18 | Justice Cappy worked to forge a cooperative working relationship |
19 | between the three branches of government, including the landmark |
20 | legislation and rules of court addressing the medical |
21 | malpractice crisis of 2000-2003; and |
22 | WHEREAS, This medical malpractice work between the |
23 | legislative, executive and judicial branches of government |
24 | produced a series of changes in the law and court rules that has |
25 | produced an immediate and positive result in this important area |
26 | of law; and |
27 | WHEREAS, Chief Justice Cappy served the University of |
28 | Pittsburgh as a member of its Board of Trustees for 17 years, |
29 | including chair of the board in 2003, which Chief Justice Cappy |
30 | served until his passing; and |

1 | WHEREAS, Chief Justice Cappy was a member of the Board of |
2 | Visitors for the University of Pittsburgh School of Law and |
3 | served as its chair for 12 years; and |
4 | WHEREAS, Chief Justice Cappy served as the vice chairperson |
5 | for the Board of Directors of the University of Pittsburgh |
6 | Medical Center; and |
7 | WHEREAS, In recognition of his devotion to the University of |
8 | Pittsburgh and the rule of law, Chief Justice Cappy was named an |
9 | inaugural Pitt Legacy Laureate, received the School of Law's |
10 | Distinguished Alumnus Award and in 2008 was named a University |
11 | Distinguished Alumni Fellow; and |
12 | WHEREAS, Chief Justice Cappy's outstanding contributions |
13 | earned him many other awards, including the Harry Carrico Award |
14 | by the National Center for State Courts, one of only nine Bar |
15 | Medals of the Pennsylvania Bar Association awarded in its |
16 | 114-year history; the Bar Medal, the highest honor from the |
17 | Philadelphia Bar; an Honorary Doctorate of Laws degree from |
18 | Widener University; the Mothers Against Drunk Driving Citation |
19 | of Merit; Pennsylvania State Police Man of the Year; |
20 | Pennsylvania Fraternal Order of Police Man of the Year; Italian |
21 | Heritage Foundation Man of the Year; the Allegheny County |
22 | Academy of Trial Lawyers Judicial Service Award; the Susan B. |
23 | Anthony Award from the Women's Bar Association of Western |
24 | Pennsylvania; the Allegheny County Bar Association Presidential |
25 | Award of Merit; and the Pennsylvania Association for Justice's |
26 | President's Award; and |
27 | WHEREAS, United States Supreme Court Justice William H. |
28 | Rehnquist appointed Chief Justice Cappy to the United States |
29 | Judicial Conference Committee on Federal-State Jurisdiction; and |
30 | WHEREAS, Chief Justice Cappy was a member of the Allegheny |

1 | County Bar Association, the Pennsylvania Bar Association, the |
2 | American Bar Association, the American Judicature Society, the |
3 | Justinian Society, the Pennsylvania Conference of State Trial |
4 | Court Judges, the Duquesne University Cyril H. Wecht Institute |
5 | of Forensic Science and Law, the Advisory Board of the |
6 | University of Pittsburgh Medical Center Health Systems and the |
7 | Children's Hospital of Pittsburgh; and |
8 | WHEREAS, In January 2008, Chief Justice Cappy retired from |
9 | the Supreme Court of Pennsylvania and joined the law firm of |
10 | Buchanan, Ingersoll and Rooney, PC, where his practice focused |
11 | on commercial litigation and appellate law; and |
12 | WHEREAS, Chief Justice Cappy is survived by his wife, Janet |
13 | Fry Cappy, a son, Erick A. Fry, and a sister, Patricia Smith; |
14 | therefore be it |
15 | RESOLVED, That the Senate honor the life and work of Chief |
16 | Justice Ralph J. Cappy for his great and illustrious service to |
17 | this Commonwealth and contributions to the law; and be it |
18 | further |
19 | RESOLVED, That the Senate extend condolences to the family of |
20 | Chief Justice Ralph J. Cappy upon his passing. |
