BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Section 75.002, Civil Practice and Remedies | ||
Code, is amended by adding Subsection (f-1) to read as follows: | ||
(f-1) An irrigation district is not liable for injury to an | ||
individual or property arising from the recreational use of the | ||
district's land unless the injury arises from an act or omission of | ||
the district that constitutes recklessness or intentional | ||
misconduct. | ||
SECTION 2. Section 75.002(f-1), Civil Practice and Remedies | ||
Code, as added by this Act, applies only to a cause of action that | ||
accrues on or after the effective date of this Act. | ||
SECTION 3. This Act takes effect September 1, 2023. |
