A BILL TO BE ENTITLED
 
AN ACT
  relating to the authority of a political subdivision to use public
  money to provide legal services for individuals unlawfully present
  in the United States.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Chapter 140, Local Government Code, is amended
  by adding Section 140.014 to read as follows:
         Sec. 140.014.  PROHIBITION ON USE OF PUBLIC MONEY TO PROVIDE
  LEGAL SERVICES FOR UNLAWFULLY PRESENT INDIVIDUALS. Unless required
  by the United States Constitution, a political subdivision may not:
               (1)  use public money to provide legal services for an
  individual who is unlawfully present in the United States according
  to the terms of the federal Immigration and Nationality Act (8
  U.S.C. Section 1101 et seq.); or
               (2)  provide public money to a person to be used to
  directly or indirectly provide legal services for an individual
  described by Subdivision (1).
         SECTION 2.  This Act takes effect September 1, 2023.
