relating to the authority of a political subdivision to use public | ||
money to provide legal services for individuals unlawfully present | ||
in the United States. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Chapter 140, Local Government Code, is amended | ||
by adding Section 140.014 to read as follows: | ||
Sec. 140.014. PROHIBITION ON USE OF PUBLIC MONEY TO PROVIDE | ||
LEGAL SERVICES FOR UNLAWFULLY PRESENT INDIVIDUALS. Unless required | ||
by the United States Constitution, a political subdivision may not: | ||
(1) use public money to provide legal services for an | ||
individual who is unlawfully present in the United States according | ||
to the terms of the federal Immigration and Nationality Act (8 | ||
U.S.C. Section 1101 et seq.); or | ||
(2) provide public money to a person to be used to | ||
directly or indirectly provide legal services for an individual | ||
described by Subdivision (1). | ||
SECTION 2. This Act takes effect September 1, 2023. |
