relating to customer choice for school districts served by | ||
municipally owned electric utilities and electric cooperatives. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter B, Chapter 40, Utilities Code, is | ||
amended by adding Section 40.061 to read as follows: | ||
Sec. 40.061. SCHOOL DISTRICT UTILITY CHOICE. | ||
Notwithstanding any other provision of this chapter, a school | ||
district served by a municipally owned utility that has not chosen | ||
to participate in customer choice shall, within the certificated | ||
retail service area of the utility, have the right of customer | ||
choice as if the utility had chosen to participate in customer | ||
choice. | ||
SECTION 2. Subchapter B, Chapter 41, Utilities Code, is | ||
amended by adding Section 41.064 to read as follows: | ||
Sec. 41.064. SCHOOL DISTRICT UTILITY CHOICE. | ||
Notwithstanding any other provision of this chapter, a school | ||
district served by an electric cooperative that has not chosen to | ||
participate in customer choice shall, within the certificated | ||
retail service area of the cooperative, have the right of customer | ||
choice as if the cooperative had chosen to participate in customer | ||
choice. | ||
SECTION 3. This Act takes effect September 1, 2011. |
