| electric provider. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Subchapter H, Chapter 39, Utilities Code, is | ||
| amended by adding Section 39.359 to read as follows: | ||
| Sec. 39.359. BUSINESS TO CONTINUE DURING APPEAL. The | ||
| commission shall not interrupt the retail electric provider's right | ||
| to continue conducting business and serving consumers while any | ||
| review or appeal is pending of an order revoking the provider's | ||
| certificate. | ||
| SECTION 2. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all members elected to each chamber, as | ||
| provided by Article III, Section 39 of the Texas Constitution. If | ||
| this Act does not receive the vote necessary for immediate effect, | ||
| this Act takes effect September 1, 2011. | ||
