A BILL TO BE ENTITLED
 
AN ACT
  relating to continuity of retail electric service during the
  pendency of an appeal of an order revoking the license of a retail
  electric provider.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter H, Chapter 39, Utilities Code, is
  amended by adding Section 39.359 to read as follows:
         Sec. 39.359.  BUSINESS TO CONTINUE DURING APPEAL.  The
  commission shall not interrupt the retail electric provider's right
  to continue conducting business and serving consumers while any
  review or appeal is pending of an order revoking the provider's
  certificate.
         SECTION 2.  This Act takes effect immediately if it receives
  a vote of two-thirds of all members elected to each chamber, as
  provided by Article III, Section 39 of the Texas Constitution.  If
  this Act does not receive the vote necessary for immediate effect,
  this Act takes effect September 1, 2011.
