relating to continuity of retail electric service during the | ||
pendency of an appeal of an order revoking the license of a retail | ||
electric provider. | ||
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
SECTION 1. Subchapter H, Chapter 39, Utilities Code, is | ||
amended by adding Section 39.359 to read as follows: | ||
Sec. 39.359. BUSINESS TO CONTINUE DURING APPEAL. The | ||
commission shall not interrupt the retail electric provider's right | ||
to continue conducting business and serving consumers while any | ||
review or appeal is pending of an order revoking the provider's | ||
certificate. | ||
SECTION 2. This Act takes effect immediately if it receives | ||
a vote of two-thirds of all members elected to each chamber, as | ||
provided by Article III, Section 39 of the Texas Constitution. If | ||
this Act does not receive the vote necessary for immediate effect, | ||
this Act takes effect September 1, 2011. |
