A BILL TO BE ENTITLED
 
AN ACT
  relating to alternative dispute resolution of certain insurance
  payment disputes with chiropractors.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter D, Chapter 1952, Insurance Code, is
  amended by adding Section 1952.1561 to read as follows:
         Sec. 1952.1561.  PAYMENT DISPUTES RELATING TO CHIROPRACTIC
  CARE. (a) An insurer may not bring an action related to a payment
  required under Section 1952.156 made for chiropractic care unless
  not later than one year after the date of service the chiropractor
  and the insurer have submitted the dispute to an alternative
  dispute resolution process and failed to resolve the dispute.
         (b)  The statute of limitations applicable to a cause of
  action arising out of the dispute is tolled beginning on the date
  the dispute arises and ending on the date the alternative dispute
  resolution process is completed.
         SECTION 2.  This Act applies only to an insurance policy that
  is delivered, issued for delivery, or renewed on or after January 1,
  2014. A policy delivered, issued for delivery, or renewed before
  January 1, 2014, is governed by the law as it existed immediately
  before the effective date of this Act, and that law is continued in
  effect for that purpose.
         SECTION 3.  This Act takes effect September 1, 2013.
