A BILL TO BE ENTITLED
 
AN ACT
  relating to establishing an account for the purchase or operation
  of emissions monitoring devices in certain counties.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter B, Chapter 382, Health and Safety
  Code, is amended by adding Section 382.0336 to read as follows:
         Sec. 382.0336.  URBAN COUNTY AIR MONITORING ACCOUNT. (a)
  The urban county air monitoring account is an account in the general
  revenue fund.
         (b)  The account consists of any money deposited to the
  credit of the account, including any gifts, grants, or donations
  made for purposes of this section. The commission may accept
  anonymous gifts and donations for the account.
         (c)  Money in the account may be appropriated to the
  commission only for the purchase or operation of devices that
  monitor the emissions of air contaminants in a county:
               (1)  with a population of 650,000 or more; and
               (2)  in which there are more than 2,000 producing oil or
  gas wells.
         (d)  Interest earned on the account shall be credited to the
  account.
         (e)  Section 403.095, Government Code, does not apply to the
  account.
         SECTION 2.  (a) Section 382.0336, Health and Safety Code, as
  added by this Act, is amended by adding Subsection (f) to read as
  follows:
         (f)  Except as provided by this subsection, the commission
  shall allocate all money appropriated from the account for the
  purchase or operation of devices for or through the regional air
  monitoring program described by Section 386.252(a)(5), in addition
  to other money allocated for that program. The commission shall
  ensure that money deposited to the account by a gift, grant, or
  donation that is subject to a condition is not used under this
  subsection if that use would be inconsistent with the condition. To
  the extent money remains in the account after funding needs for the
  purchase or operation of devices for or through the regional air
  monitoring program described by that section are met, the
  commission may use money as provided by Subsection (c).
         (b)  This section takes effect only if H.B. 1145 or S.B. 527,
  or similar legislation relating to projects funded through the
  Texas emissions reduction plan, is enacted by the 82nd Legislature,
  Regular Session, 2011, and becomes law.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2011.
