| relating to the emergency food assistance program administered by | ||
| the Department of Agriculture. | ||
| BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Chapter 12, Agriculture Code, is amended by | ||
| adding Section 12.052 to read as follows: | ||
| Sec. 12.052. EMERGENCY FOOD ASSISTANCE PROGRAM. In | ||
| administering the emergency food assistance program under Section | ||
| 12.0025, the department shall include in the eligibility criteria | ||
| for replacing perishable foods households that are located in an | ||
| area declared to be a disaster area by the governor or the president | ||
| of the United States. | ||
| SECTION 2. As soon as practicable after the effective date | ||
| of this Act, the Department of Agriculture shall adopt rules | ||
| necessary to implement the changes in law made by this Act. | ||
| SECTION 3. This Act takes effect immediately if it receives | ||
| a vote of two-thirds of all the members elected to each house, as | ||
| provided by Section 39, Article III, Texas Constitution. If this | ||
| Act does not receive the vote necessary for immediate effect, this | ||
| Act takes effect September 1, 2023. | ||
