A BILL TO BE ENTITLED
 
AN ACT
  relating to a review by a local law enforcement agency of a school
  district's multihazard emergency operations plan.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Section 37.2071, Education Code, is amended by
  adding Subsections (a-1), (h-1), and (h-2) to read as follows:
         (a-1)  Before submitting a multihazard emergency operations
  plan to the center at the center's request under Subsection (b), a
  school district shall request provisional feedback from the center
  regarding the plan.  The school district shall make adjustments to
  its plan as necessary.
         (h-1)  After approval of a plan by the center under this
  section, a school district shall submit its plan to an appropriate
  local law enforcement agency for review and to provide suggestions
  on the plan.
         (h-2)  For purposes of Subsection (h-1), an appropriate
  local law enforcement agency includes:
               (1)  a school district police department, if the
  district employs and commissions at least 20 full-time peace
  officers;
               (2)  the police department of a municipality in which
  the district is located;
               (3)  the emergency management agency of a county in
  which the district is located, if applicable; and
               (4)  the sheriff of the county in which the district is
  located.
         SECTION 2.  This Act applies beginning with the 2023-2024
  school year.
         SECTION 3.  This Act takes effect immediately if it receives
  a vote of two-thirds of all the members elected to each house, as
  provided by Section 39, Article III, Texas Constitution.  If this
  Act does not receive the vote necessary for immediate effect, this
  Act takes effect September 1, 2023.
