A BILL TO BE ENTITLED
 
AN ACT
  relating to requirements for the use on the state's international
  border of motion detection cameras and for camera data storage from
  those cameras.
         BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS:
         SECTION 1.  Subchapter A, Chapter 411, Government Code, is
  amended by adding Section 411.00951 to read as follows:
         Sec. 411.00951.  REQUIREMENTS FOR BORDER MOTION DETECTION
  CAMERAS AND DATA STORAGE. (a) In this section, "company" has the
  meaning assigned by Business & Commerce Code, Section 113.001.
         (b)  In any program the department establishes or has
  established to monitor this state's international border, the
  department shall use motion detection cameras manufactured in this
  state and by a company headquartered in this state.
         (c)  The department may not use a device to store data from a
  motion detection camera unless the device is:
               (1)  located in the United States; and
               (2)  operated by a company headquartered in this state.
         (d)  Notwithstanding Subsection (b), if the department
  cannot use a motion detection camera described in Subsection (b),
  the department shall:
               (1)  use a motion detection camera that is
  manufactured:
                     (A)  outside this state but within the United
  States; and
                     (B)  by a company headquartered outside this state
  but within the United States; and
               (2)  use FIRSTNET motion detection cameras.
         (d)  Notwithstanding Subsection (c), the department may use
  a device to store data from a motion detection camera that is
  operated outside this state but within the United States if a
  company described in Subsection (c)(2) cannot store the data.
         SECTION 2.  Section 411.00951, Government Code, as added by
  this Act, applies only to a contract for the purchase of motion
  detection cameras or the storage of data from motion detection
  cameras entered into on or after the effective date of this Act.
         SECTION 3.  This Act takes effect September 1, 2023.
