| proposing a constitutional amendment relating to the right of a | ||
| property owner to conduct activities necessary to secure basic | ||
| human needs. | ||
| BE IT RESOLVED BY THE LEGISLATURE OF THE STATE OF TEXAS: | ||
| SECTION 1. Article I, Texas Constitution, is amended by | ||
| adding Section 36 to read as follows: | ||
| Sec. 36. (a) An individual in this state has the right to | ||
| conduct activities on the individual's homestead property to secure | ||
| for the residents of that property access to food, water, electric | ||
| power, and shelter, subject to laws protecting public health and | ||
| safety and laws for the conservation and development of the natural | ||
| resources of this state. | ||
| (b) The legislature may enact laws to protect this right. | ||
| SECTION 2. This proposed constitutional amendment shall be | ||
| submitted to the voters at an election to be held November 7, 2023. | ||
| The ballot shall be printed to permit voting for or against the | ||
| proposition: "The constitutional amendment recognizing the right | ||
| of an individual to act to secure access to food, water, electric | ||
| power, and shelter on the individual's homestead property, subject | ||
| to laws that protect public health and safety and laws for the | ||
| conservation and development of the natural resources of this | ||
| state." | ||
