Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Article 1 of Chapter 17 of Title 15.2 a section numbered 15.2-1723.3 as follows:

§15.2-1723.3. Security camera monitoring by law-enforcement agencies.

A. For purposes of this section, "security camera" means an analog or digital photographic or video camera or other device capable of recording or transmitting a photograph, motion picture, or other digital image that has been installed outdoors at a person's residence or any business or commercial establishment within the Commonwealth.

B. Any law-enforcement agency having jurisdiction over criminal law enforcement or regulatory violations may establish a program to allow for the monitoring or reviewing of security cameras for the purpose of tracking and reducing crime by such law-enforcement agency. Such program may allow any resident or business or commercial establishment within the Commonwealth that owns a security camera to opt in to the monitoring program. Any law-enforcement agency establishing such program shall develop a policy for how such security cameras will be monitored and how such data from such security cameras will be used and maintained. A copy of such policy shall be given to any person who opts in to the monitoring program.
