A BILL to amend the Code of Virginia by adding in Chapter 22.2 of Title 19.2 a section numbered 19.2-386.36, relating to federal equitable sharing funds received by state agencies.

Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding in Chapter 22.2 of Title 19.2 a section numbered 19.2-386.36 as follows:

§19.2-386.36. Federal equitable sharing funds received by state agencies.

Any federal equitable sharing funds received by a state agency shall be deposited into the general fund. Such funds may be appropriated for any purpose in a manner consistent with federal law.

For the purpose of this section, "federal equitable sharing funds" means any federally forfeited property that is shared by the United States Attorney General or the United States Secretary of the Treasury with a law-enforcement agency pursuant to 18 U.S.C. §981(e)(2), 19 U.S.C. §1616a, 21 U.S.C. §881(e)(1)(A), or 31 U.S.C. §§ 9705(b)(4)(A) and (B).
