Be it enacted by the General Assembly of Virginia:

1. That the Code of Virginia is amended by adding a section numbered 38.2-613.02 as follows:

§38.2-613.02. Disclosure of summary health information.

A. As used in this section:

"Group health plan" has the same meaning as provided in 45 C.F.R. §160.103.

"HIPAA" means the federal Health Insurance Portability and Accountability Act (42 U.S.C. §1320d et seq.).

"Plan sponsor" has the same meaning as provided in 29 U.S.C. 1002(16)(B).

"Summary health information" has the same meaning as provided in 45 C.F.R. §164.504.

B. To the extent permitted by HIPAA, its implementing regulations including 45 C.F.R. §164.504, this chapter, and any other state or federal law, a group health plan that has 50 or more participants shall disclose summary health information to the plan sponsor if the plan sponsor requests the summary health information for the purposes of (i) obtaining premium bids from health plans for providing health insurance coverage under the group health plan or (ii) modifying, amending, or terminating the group health plan.
