A BILL to require the Board of Agriculture and Consumer Services to adopt regulations that permit the transportation of animals by law-enforcement officers, animal control officers, and releasing agencies by vehicles that are not enclosed under certain conditions.

Be it enacted by the General Assembly of Virginia:

1.  §1. That the Board of Agriculture and Consumer Services adopt regulations that permit the non-commercial, intrastate transportation of animals by law-enforcement officers, animal control officers, and releasing agencies by vehicles that are not enclosed, provided that (i) the primary enclosure is affixed to the vehicle in a manner that prevents any movement of such enclosure during transport; (ii) the primary enclosure is in compliance with the federal Animal Welfare regulations specifying the standards for such enclosures at 9 C.F.R. §3.14; (iii) the animal is transported without delay, and for a duration not reasonably expected to exceed two hours; and (iv) the animal is protected from the elements during transport. For the purposes of this regulation, "protected from the elements" means that the top and at least three sides of the primary enclosure are closed. Auxiliary heat or ventilation shall be required if the animal is not acclimated due to age, illness, or other condition; or if the duration of transport exceeds two hours and temperatures remain below 45 degrees Fahrenheit, or above 85 degrees Fahrenheit, for the duration of transport.
