12103699D Be it enacted by the General Assembly of Virginia: 1. That the Code of Virginia is amended by adding a section numbered 8.01-27.5, by adding in Article 1 of Chapter 5 of Title 32.1 a section numbered 32.1-137.02, and by adding a section numbered 54.1-2910.02 as follows: §8.01-27.5. Civil liability for professional services. If a hospital or physician fails to process a health insurance claim in a timely manner as required by §§32.1-137.02 and 54.1-2910.02, the patient shall not be liable to the hospital or physician for any amount in excess of what the patient would owe if the hospital or physician had properly processed the insurance claim. §32.1-137.02. Processing patient's health insurance claims. Any hospital that treats a patient who presents proof of health insurance providing coverage within the applicable provider network shall not refuse to process, or cause unreasonable delay in the processing of, such patient's claims. §54.1-2910.02. Processing patient's health insurance claims. Any doctor of medicine, osteopathy, or podiatry who treats a patient who presents proof of health insurance providing coverage within the applicable provider network shall not refuse to process, or cause unreasonable delay in the processing of, such patient's claims. |
