Summary

The purpose of this article relates to the responsibilities of the Real Estate director. The bill permits the director to acquire real property and to contract for third-party real estate services. The bill permits the spending units to be billed for the actual costs of those third-party services and to be billed for the services of the Real Estate Division. The bill creates the Real Property Fund and establishes what revenues are to be deposited into that fund. The bill requires revenue associated with wireless communication towers to be deposited into the fund instead of the General Revenue Fund, unless the property is subject to a pledge of its revenues in connection with a preexisting revenue bond issue. The bill establishes what moneys from the fund may be used for. The bill also exempts real property owned by the Department of Agriculture and the West Virginia State Conservation Committee from certain accounting and reporting requirements.
