A BILL to amend and reenact §64-6-1 of the Code of West Virginia, 1931, as amended, relating to directing the State Fire Commission to promulgate a legislative rule related to code official certification standards with certain amendments.
Be it enacted by the Legislature of West Virginia:
ARTICLE 6. AUTHORIZATION FOR DEPARTMENT OF MILITARY AFFAIRS AND PUBLIC SAFETY TO PROMULGATE LEGISLATIVE RULES AND REPEAL OF UNAUTHORIZED AND OBSOLETE LEGISLATIVE RULES RELATING TO THE DEPARTMENT OF MILITARY AFFAIRS AND PUBLIC SAFETY.
§.64-6-1. Fire Commission.
The Legislature directs the State Fire Commission, pursuant to the authority given to the Commission in §29-3-5b of this code, to promulgate the legislative rule filed in the State Register by the commission on May 3, 2016, relating to the commission (standards for the certification and continuing education of municipal, county, and other public sector building code officials, building code inspectors and plan examiners, 87 CSR 7) with the following amendments:
On page four, paragraph 3.1.b.3. by striking out the words “and hold a valid WV Master Electrician’s License”;
On page four, paragraph 3.1.b.4. by striking out the words “and hold a valid WV Master Electrician’s License”; and
On page five, paragraph 3.1.c.3. by striking out the words “and hold a valid WV Master Electrician’s License”.
NOTE: The purpose of this bill is to direct the promulgation of fire commission rules to remove the current requirement that electrical inspectors have a master electrician license in order to make the requirements consistent with other inspector requirements.
