AN ACT

 

amending Title 15, chapter 1, article 8, Arizona Revised Statutes, by adding section 15-185.01; amending Title 15, chapter 9, article 1, Arizona Revised Statutes, by adding section 15‑902; relating to school finance.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 1, article 8, Arizona Revised Statutes, is amended by adding section 15-185.01, to read:

START_STATUTE15-185.01.  Charter schools; current year student count

Notwithstanding section 15‑185, subsection B, beginning in the 2011‑2012 school year, a charter school may revise the student count at any time before the first one hundred days or two hundred days in session, as applicable. END_STATUTE

Sec. 2.  Title 15, chapter 9, article 1, Arizona Revised Statutes, is amended by adding section 15‑902, to read:

START_STATUTE15-902.  School districts; current year student count

Notwithstanding any other law, beginning in the 2011‑2012 school year, the student count shall be determined initially each year using an estimated base student count based on the final student count for that school district during the previous school year, the actual registration of pupils before the beginning of the current school year and the anticipated increase or decrease of student population for the current year.  The school district shall report the estimated base student count to the department of education, which shall determine per pupil funding for that school district based on the estimated base student count.  After the first one hundred days or two hundred days in session, as applicable, the school district shall revise the student count to be equal to the actual average daily membership, as defined in section 15‑901, or the adjusted average daily membership.  Before the one hundredth day or two hundredth day in session, as applicable, the state board of education may require a school district to report periodically regarding pupil enrollment and attendance, and the department of education may revise its computation of state aid and equalization assistance based on the report. A school district shall revise its student count and base support level before May 15.  A school district that overestimated its student count shall revise its budget before May 15.  A school district that underestimated its student count may revise its budget before May 15. Sec. 3.  Conforming legislation

The legislative council staff shall prepare proposed legislation conforming the Arizona Revised Statutes to the provisions of this act for consideration in the fiftieth legislature, second regular session.
