A CONCURRENT RESOLUTION

 

proposing an amendment to the Constitution of Arizona; amending article IV, part 1, CONSTITUTION of Arizona, by adding section 3; relating to initiative and referendum.

Be it resolved by the House of Representatives of the State of Arizona, the Senate concurring:

1.  Article IV, part 1, Constitution of Arizona, is proposed to be amended by adding section 3 as follows if approved by the voters and on proclamation of the Governor:

3.  Statewide initiative and referendum measures; reauthorization requirement; exception

A.  Beginning in 2016, for statewide initiative and referendum measures that are approved by a vote of the people in 2016 and later and that are explicitly designated by their terms to be subject to the voter protection act of 1998, the following apply:

1.  The legislature shall not have the power to amend, repeal or supersede a statewide initiative measure approved by a majority of the votes cast thereon, or to amend a referendum measure decided by a majority of the votes cast thereon, unless the amending legislation furthers the purposes of such measure and at least three‑fourths of the members of each house of the legislature, by a roll call of ayes and nays, vote to amend such measure.

2.  Each initiative and referendum measure approved shall be referred to a subsequent vote of the people eight years after the measure's initial approval.  The subsequent vote of the people shall be on the question of whether to reauthorize the measure, and a yes vote shall be a vote to reauthorize the measure.  If the majority of those voting on the REAUTHORIZATION do not vote to reauthorize the measure, the measure is repealed and of no further legal effect.

B.  Beginning in 2016, for statewide initiative and referendum measures that are approved by a vote of the people in 2016 and later and that do not specifically provide that they are SUBJECT to the voter protection act of 1998, the legislature retains full legislative authority and may adopt any enactment to amend, repeal, supersede or otherwise modify the provisions of that initiated or referred measure.

2.  The Secretary of State shall submit this proposition to the voters at the next general election as provided by article XXI, Constitution of Arizona.
