AN ACT

 

amending Title 15, chapter 7, article 3.1, Arizona Revised Statutes, by adding section 15-758; making an appropriation; relating to English language education.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 15, chapter 7, article 3.1, Arizona Revised Statutes, is amended by adding section 15-758, to read:

START_STATUTE15-758.  Research‑based educational technology; request for proposals; selection of provider; audits; annual report

A.  The state board of education shall submit a request for proposals to educational technology providers for the delivery of research‑based educational technology to prepare pupils in this state who are classified as English language learners to attain English proficiency. The state board of education shall establish the format of the applications, application procedures and selection criteria.  The state board of education shall select and award a contract to one educational technology provider to deliver research‑based educational technology and shall distribute monies appropriated for this purpose to the selected provider.

B.  The educational technology provider shall deliver research‑based educational technology that:

1.  Is designed to accelerate English language learning by:

(a)  Developing oral academic vocabulary through word videos and cloze sentences.

(b)  Phonemic awareness instruction, including directly instructed phonemes shared by native and English languages and new phonemes.

(c)  Listening and speaking, including assessing a pupil's understanding of communicative context.

(d)  Directly teaching phonics and reading, including echo reading and recording of decodable books, with every reading word translated in at least ten languages to support comprehension.

2.  Is easy for teachers to understand and implement without requiring supervision and extensive management and allows teachers the option of:

(a)  Administering assessment.

(b)  Setting first language support.

(c)  Selecting print options.

(d)  Session time.

3.  Provides English language development strategies that include modeling, guided practice, realia and comprehensible input.

4.  Provides curriculum that is based on current scientific research, state standards and no child left behind guidelines.

5.  Provides software that is current with frequent content and technology updates that occur at least once a year.

6.  Provides software that is user‑friendly and that provides initial tutorials that introduce children to the computer, mouse and other buttons.

7.  Provides strategic first language support in at least ten languages to pupils, using the pupil's first language as a bridge to English language acquisition.  First language support shall fade as the pupil improves in language skills.  Conceptually difficult concepts shall be customized for each language.

8.  Provides immediate feedback that is informative and that includes first language explanations or reviews in at least ten languages through simplified instruction or video.

9.  Provides individualized instruction that includes immediate remediation and delayed remediation.

10.  Provides on‑site assistance and support in less than twenty‑four hours if technical problems arise.

11.  Provides integrated and adaptive preassessment and postassessment of skills developed by the software.  The assessment shall influence pupil instruction.

12.  Provides printable real‑time individual reports and classroom reports.

13.  Provides printouts and progress reports for parents in at least ten languages in the language spoken in the pupil's home.

14.  Provides a complete breakdown of the levels and activities available.

C.  The auditor general shall conduct annual financial audits of the research‑based educational technology provided pursuant to this section.

D.  The state board of education shall submit an annual report on or before December 31 to the governor, the speaker of the house of representatives and the president of the senate regarding the research‑based educational technology provided pursuant to this section, including information on the number of school districts and charter schools that participate, the number of pupils who participate and the effectiveness of research‑based educational technology.  The state board of education shall submit a copy of this report to the secretary of state.  END_STATUTE

Sec. 2.  Appropriation; research‑based educational technology

The sum of $12,000,000 is appropriated from the state general fund in fiscal year 2010-2011 to the state board of education for payment to the educational technology provider selected by the state board of education pursuant to section 15‑758, Arizona Revised Statutes, as added by this act.
