AN ACT

 

Amending title 36, chapter 5.1, ARTICLE 1, Arizona Revised Statutes, by adding section 36-567; relating to developmental disabilities.

Be it enacted by the Legislature of the State of Arizona:

Section 1.  Title 36, chapter 5.1, article 1, Arizona Revised Statutes, is amended by adding section 36-567, to read:

START_STATUTE36-567.  Music therapists; minimum qualifications; definition

A.  The division by rule shall establish qualifications for persons who provide music therapy services to person with developmental disabilities.  At a minimum these qualifications shall require current certification by a national certification board for music therapists.  The division shall classify services provided by music therapists who meet these qualifications as music therapy.

B.  For the purposes of this section, "music therapy" means the clinical and evidence-based use of music interventions to accomplish individualized goals in a therapeutic relationship and includes:

1.  The assessment of a client's emotional and physical health, social functioning, communication abilities and cognitive skills through the client's history and the observation and interaction of the client in music and nonmusic settings.

2.  The development and implementation of treatment plans, based on a client's assessed needs, using music interventions including music improvisation, receptive music listening, song writing, lyric discussion, music and imagery, music performance, learning through music and movement to music.

3.  The evaluation and documentation of the client's response to treatment.

4.  Conducting an individualized assessment to collect systematic, comprehensive and accurate data necessary to determine the course of action and subsequent individualized treatment plan.

5.  Planning and developing an individualized music therapy treatment plan that identifies the client's goals, objectives and potential treatment intervention strategies.

6.  Implementing an individualized music therapy treatment plan that is consistent with the client's overall treatment program.

7.  Systematically evaluating and comparing the client's response to the individualized music therapy treatment plan and suggesting modifications as appropriate.

8.  Developing a discharge plan in collaboration with the client, the client's family, the treatment team and other identified support networks.

9.  Minimizing the impact of environmental constraints as a barrier to participation for individuals engaging in music therapy.

10.  Collaborating with and educating the client and others to foster an environment that is responsive to the developmental needs of the client as addressed in music therapy.

11.  Consulting with groups, programs, organizations and communities to improve accessibility to music therapy services. END_STATUTE
