An act relating to public lands.

AB 1191, as introduced, Bonta. Public lands: Howard Terminal: Oakland Sports and Mixed-Use Project.

Under existing law, known as the public trust doctrine, the state has title as trustee to all tidelands and navigable lakes and streams and is charged with preserving these waterways for navigation, commerce, and fishing, as well as for scientific study, recreation, and as an open space and habitat for birds and marine life. Existing law vests with the State Lands Commission control over specified state lands, including tidelands and submerged lands. Existing law grants to various local entities the right, title, and interest of the state in and to certain tidelands and submerged lands in trust generally for purposes of commerce, navigation, and fisheries, and for other public trust purposes.

This bill would state the intent of the Legislature to enact subsequent legislation that would authorize the State Lands Commission to approve the Oakland Sports and Mixed-Use Project, or portions of the project, at the Howard Terminal in the City of Oakland as a trust use on public lands if certain conditions are met.

The people of the State of California do enact as follows:

SECTION 1.

It is the intent of the Legislature to enact subsequent legislation that would authorize the State Lands Commission to approve the Oakland Sports and Mixed-Use Project, or portions of the project, at the Howard Terminal in the City of Oakland as a trust use on public lands if certain conditions are met.
