   An act to add Section 14035.6 to the Government Code, relating to
transportation.


	LEGISLATIVE COUNSEL'S DIGEST


   AB 2355, as introduced, Dababneh. Intercity rail services:
mitigation.
   Existing law authorizes the Department of Transportation to
contract with Amtrak for intercity rail passenger services and
provides funding for these services from the Public Transportation
Account.
   This bill would require the department to develop a program for
the reasonable mitigation of noise and vibration levels in
residential neighborhoods along railroad lines where the department
contracts for state-funded intercity rail passenger service. The bill
would require the department to determine what constitutes a
reasonable level of mitigation. The bill would provide that funding
for the mitigation program shall be made available from funds
appropriated by the Legislature for this purpose.
   Vote: majority. Appropriation: no. Fiscal committee: yes.
State-mandated local program: no.


THE PEOPLE OF THE STATE OF CALIFORNIA DO ENACT AS FOLLOWS:

  SECTION 1.  Section 14035.6 is added to the Government Code, to
read:
   14035.6.  The department shall develop a program for the
reasonable mitigation of noise and vibration levels in residential
neighborhoods along railroad lines where the department contracts for
state-funded intercity rail passenger service pursuant to Section
14035. The department shall determine what constitutes a reasonable
level of mitigation. Funding for the mitigation program shall be made
available from funds appropriated by the Legislature for this
purpose.
