An act to add Section 15305 to the Vehicle Code, relating to vehicles.

AB 2950, as introduced, Sanchez. Vehicles: sanctions.

Existing law prohibits a driver from operating a commercial motor vehicle for the rest of their life if they use a motor vehicle in the commission of a felony involving distribution, dispensing, or manufacturing a controlled substance. Existing law generally makes a violation of any provision of the Vehicle Code an infraction.

This bill would similarly prohibit a driver if they use a motor vehicle in the commission of a felony involving human trafficking. Because a violation of this provision would be punishable as an infraction, this bill would create a state-mandated local program.

The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.

This bill would provide that no reimbursement is required by this act for a specified reason.

The people of the State of California do enact as follows:

SECTION 1.

 Section 15305 is added to the Vehicle Code, to read:

15305.

 A driver shall not operate a commercial motor vehicle for the rest of their life if they use a motor vehicle in the commission of a felony, involving an act or practice of trafficking persons, as described in 22 U.S.C. Section 7102 or Penal Code Section 236.1.

SEC. 2.

 No reimbursement is required by this act pursuant to Section 6 of Article XIII B of the California Constitution because the only costs that may be incurred by a local agency or school district will be incurred because this act creates a new crime or infraction, eliminates a crime or infraction, or changes the penalty for a crime or infraction, within the meaning of Section 17556 of the Government Code, or changes the definition of a crime within the meaning of Section 6 of Article XIII B of the California Constitution.
