CALIFORNIA LEGISLATURE— 2019–2020 REGULAR SESSION

Assembly Bill No. 773

Introduced by Assembly Member Gonzalez

February 19, 2019

An act to amend Section 49040 of, and to add Section 49042 to, the Education Code, relating to voter registration.

LEGISLATIVE COUNSEL'S DIGEST

AB 773, as introduced, Gonzalez. Voter registration: high school pupils.
(1) Existing law requires the last 2 full weeks in April and in September to be known as “high school voter education weeks,” during which time persons authorized by the county elections official are allowed to register to vote pupils and school personnel on high school campuses.
This bill would provide that, in presidential election years only, the last 2 full weeks in January and in September would be known as “high school voter education weeks.” The dates in existing law would remain the same in the other years.
The bill would require school districts to develop and present, in coordination with county election officials, educational programming, as defined, to provide designated information about voter registration to pupils in grade 12 in assemblies and presentations on high school campuses during high school voter education weeks. The bill would require that school districts offer pupils the opportunity to preregister to vote during the assembly or presentation, as specified.
To the extent the bill would create new duties for school districts and county elections officers, it would constitute a state-mandated local program.
(2) The California Constitution requires the state to reimburse local agencies and school districts for certain costs mandated by the state. Statutory provisions establish procedures for making that reimbursement.
This bill would provide that, if the Commission on State Mandates determines that the bill contains costs mandated by the state, reimbursement for those costs shall be made pursuant to the statutory provisions noted above.
