AN ACT CONCERNING MEDICAID PENALTIES FOR AFTER-DISCOVERED ASSETS.
Be it enacted by the Senate and House of Representatives in General Assembly convened:
That section 17b-261a be amended to require the Commissioner of Social Services, to the extent permissible under federal law, to treat assets discovered by a Medicaid applicant after he or she applies for Medicaid as not available to the applicant until the date of discovery for the purpose of establishing a starting date for any Medicaid penalty period.
Statement of Purpose:
To make state Medicaid law regarding after-discovered assets consistent with Social Security eligibility standards.
