HOUSE BILL NO. 108

AN ACT TO AMEND TITLES 11 AND 21 OF THE DELAWARE CODE RELATING TO MOTOR VEHICLE OFFENSES EXEMPTED FROM VOLUNTARY ASSESSMENT AND THE AVAILABILITY OF PROBATION BEFORE JUDGMENT.


BE IT ENACTED BY THE GENERAL ASSEMBLY OF THE STATE OF DELAWARE:


Section 1.Amend §709(e), Title 21 of the Delaware Code by redesignating current subsections "(9), (10), (11), (12), (13), (14), (15) and (16)" as subsections "(10), (11), (12), (13), (14), (15), (16) and (17)" respectively and inserting a new subsection (9) therein to read as follows:

"(9)Violation of §4172 of this title;".

Section 2.Amend §4218(a), Title 11 of the Delaware Code by inserting after the phrase "or for violations of §4166(d) of Title 21," the following language:

"or for violations of §4172 of Title 21,".


SYNOPSIS

This Bill provides that a violation of 21 Del. C. §4172 is exempted from those motor vehicle offenses that are subject to voluntary assessment.Section 4172 provides for enhanced penalties, including suspension of license, and is consistent with motor vehicle violations currently exempted from voluntary assessment.This Bill also retains the option of probation before judgment for this offense.
