    1                        A bill to be entitled                      
    2         An act relating to proprietorship by nonphysicians;
    3         creating s. 458.45, F.S.; prohibiting specified acts
    4         by persons or entities other than licensed physicians
    5         and licensed entities; providing an effective date.

    7  Be It Enacted by the Legislature of the State of Florida:
    8  
    9         Section 1. Section 458.45, Florida Statutes, is created to
   10  read:
   11         458.45Proprietorship by nonphysicians.—A person other than
   12  a physician licensed under this chapter, or an entity other than
   13  a group of physicians, a not-for-profit hospital, or a medical
   14  school licensed pursuant to general law, may not do any of the
   15  following:
   16         (1)Employ a physician.
   17         (2)Direct, control, or interfere with a physician’s
   18  clinical judgment.
   19         (3)Have a relationship with a physician which would allow
   20  the unlicensed person or entity to exercise control over any of
   21  the following:
   22         (a)The selection of a course of treatment for a patient,
   23  the procedures or materials to be used as part of such course of
   24  treatment, or the manner in which such course of treatment is
   25  carried out by the physician.
   26         (b)The patient records of the physician.
   27         (c)Policies and decisions relating to billing and
   28  advertising.
   29         (d)Policies and decisions relating to physician staffing,
   30  office personnel, and hours of practice.
   31         Section 2. This act shall take effect July 1, 2024.
