    1                        A bill to be entitled                      
    2         An act relating to home inspectors; amending s.
    3         468.8312, F.S.; limiting the amount of a specified
    4         examination fee; amending s. 468.8313, F.S.;
    5         authorizing the Department of Business and
    6         Professional Regulation to review and approve
    7         examinations that it has certified as meeting
    8         generally accepted testing standards and specified
    9         requirements of a national examination; providing an
   10         effective date.

   12  Be It Enacted by the Legislature of the State of Florida:
   13  
   14         Section 1. Subsection (2) of section 468.8312, Florida
   15  Statutes, is amended to read:
   16         468.8312 Fees.—
   17         (2) The initial application and examination fee may not
   18  shall not exceed $125 plus the actual per applicant cost to the
   19  department to purchase an examination, if the department chooses
   20  to purchase the examination. The examination fee must be shall
   21  be in an amount that covers the cost of obtaining and
   22  administering the examination, but may not exceed $200, and must
   23  shall be refunded if the applicant is found ineligible to sit
   24  for the examination. The application fee is shall be
   25  nonrefundable.
   26         Section 2. Subsection (4) of section 468.8313, Florida
   27  Statutes, is amended to read:
   28         468.8313 Examinations.—
   29         (4) The department may review and approve examinations that
   30  the department has certified as meeting generally accepted
   31  testing standards and the requirements of a national examination
   32  as provided in s. 455.217(1)(d) by a nationally recognized
   33  entity that offers programs or sets standards that ensure
   34  competence as a home inspector.
   35         Section 3. This act shall take effect February 1, 2020.
