BILL TO BE ENTITLED
AN ACT
AN ACT
To
amend Article 11 of Chapter 6 of Title 40 of the Official Code of Georgia
Annotated, relating to miscellaneous provisions regarding the uniform rules of
the road, so as to require securing or containing of live animals on or in
motor vehicles operated on paved public roads; to repeal conflicting laws; and
for other purposes.
BE
IT ENACTED BY THE GENERAL ASSEMBLY OF GEORGIA:
SECTION
1.
Article
11 of Chapter 6 of Title 40 of the Official Code of Georgia Annotated, relating
to miscellaneous provisions regarding the uniform rules of the road, is amended
by adding a new Code section as follows:
"40-6-254.1.
(a)
No person driving a motor vehicle shall transport any animal in the back of the
vehicle in a space intended for any load on the vehicle on a paved public road
unless the space is enclosed or has side and tail racks to a height of at least
46 inches extending vertically from the floor, the vehicle has installed means
of preventing the animal from being discharged, or the animal is cross-tethered
to the vehicle or secured by a harness that encircles the shoulders and rib
cage, or is protected by a secured container which will prevent the animal from
being thrown, falling, or jumping from the vehicle.
(b)
This Code section shall not apply to:
(1)
The transportation of livestock;
(2)
The transportation of a dog whose owner either owns or is employed by a ranching
or farming operation who is traveling on a road in a rural area or who is
traveling to and from a livestock auction; and
(3)
The transportation of a dog for purposes associated with ranching or
farming.
(c)
Any person who operates a vehicle in violation of this Code section shall be
guilty of a
misdemeanor."
SECTION
2.
All
laws and parts of laws in conflict with this Act are repealed.
