A BILL FOR AN ACT

 

 

RELATING TO VEHICLE INSPECTIONS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 286, Hawaii Revised Statutes, is amended by adding a new section to part II to be appropriately designated and to read as follows:

     "§286-     Vehicle inspector; certification; renewal.  (a)  The director shall supervise and certify all inspectors authorized to conduct vehicle inspections at official inspection stations.  The director shall:

     (1)  Determine minimum standards and application criteria for inspectors;

     (2)  Administer written and performance examinations for all applicants;

     (3)  Issue official inspector certificates;

     (4)  Monitor inspection activities of inspectors;

     (5)  Conduct investigations of reported or suspected improper inspection activities; and

     (6)  Issue fines, in an amount determined by rule, to inspectors that the director finds are not properly conducting inspections; provided that after three violations, the inspector certificate shall be subject to suspension or revocation.

     (b)  Inspector certificates shall expire two years from the date of issuance, unless revoked or suspended by the director.

     (c)  Recertification of inspectors shall follow the application process for initial certification; provided that the inspector shall only be required to complete and pass the written examination administered by the director."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect on July 1, 2050.

Description:

Codifies certain certification, renewal, and violation processes of vehicle inspectors who conduct vehicle safety inspections under the DOT.  Takes effect on 7/1/2050.  (HD1)
