A BILL FOR AN ACT

 

 

RELATING to urban growth commission.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 205, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§205-     Urban growth commission; established  (a)  There is established an urban growth commission within the department for administrative purposes.  Notwithstanding any law to the contrary, the commission shall establish standards for density, building design, and infrastructure, and other standards the commission deems necessary to mitigate adverse impacts of development on the surrounding community, within urban growth boundaries.

     (b)  The commission shall convene in 2013, and every five years thereafter, and shall consist of:

     (1)  The chairperson of the board of land and natural resources, who shall serve as chairperson of the commission;

     (2)  The executive director of the Hawaii community development authority;

     (3)  The director of transportation;

     (4)  The director of planning and permitting of the city and county of Honolulu;

     (5)  The director of planning of the county of Hawaii;

     (6)  The director of planning of the county of Kauai;

     (7)  The director of planning of the county of Maui;

     (8)  One faculty member from the department of urban and regional planning at the university of Hawaii at Manoa;

     (9)  One member appointed by the governor;

    (10)  One member appointed by the president of the senate; and

    (11)  One member appointed by the speaker of the house of representatives.

     (c)  The members of the commission shall serve without compensation but shall be reimbursed for travel and other necessary expenses.

     (d)  The development standards established by the commission pursuant to subsection (a) shall be adopted in accordance with chapter 91.  Notwithstanding any law, ordinance, or rule to the contrary, the development standards established by the commission shall supersede all state and county development standards applicable within urban growth boundaries; provided that environmental review requirements established under chapter 343 shall not be superseded.  The development standards shall remain in force and effect until amended, replaced, or repealed by a subsequent urban growth commission."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
