A BILL FOR AN ACT

 

 

RELATING TO CAPITAL IMPROVEMENT PROJECTS.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 103, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§103-     Capital improvement projects; public-private partnerships; naming public structures after private contributors.  (a)  Whenever feasible, the State may accept contributions from private individuals or entities for the purpose of funding a capital improvement project.  The contracting agency may enter into an agreement to allow a private individual or entity to name the capital improvement project partially or wholly funded by the private individual or entity's contribution.

(b)  To qualify for the naming of a capital improvement project by a private individual or entity under subsection (a), the private individual or entity shall execute a contract with the public contracting agency that requires the private individual or entity to contribute not less than       per cent of the total cost of a capital improvement project.

The contracting agency may establish a limit on the length of time the public structure will bear the name selected by the contributing private individual or entity based upon the percentage of funding of the total cost of the capital improvement project that was contributed.  In addition, the contracting agency may reserve the right, in its discretion, to reject or alter a name proposed by a contributing private individual or entity.

(c)  The department of accounting and general services shall adopt rules pursuant to chapter 91 to implement this section."

     SECTION 2.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect upon its approval.
