A BILL FOR AN ACT
RElating to professions and occupations.
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:
SECTION 1. The Hawaii Revised Statutes is amended by adding a new chapter to title 25 to be appropriately designated and to read as follows:
"Chapter
Pharmacy Benefit managers
§ ‑1 Definitions. For the purposes of this chapter, unless the context otherwise requires:
"Department" means the department of commerce and consumer affairs.
"Director" means the director of commerce and consumer affairs.
"Pharmacy benefit manager" means any third party manager of a prescription drug program employed by or under contract with a pharmacy operating pursuant to chapter 461.
§ ‑2 Registration. (a) No pharmacy benefit manager shall operate in the State without registering annually with the department.
(b) All registered pharmacy benefit managers shall notify the department of any registration-related changes within ten days.
§ ‑3 Registration fee. The department shall assess an initial registration fee and a subsequent annual registration fee to be determined by the director and adjusted from time to time, which shall be deposited into the compliance resolution fund in accordance with section 26-9(o).
§ ‑4 Rules. The director may adopt rules, pursuant to chapter 91, as the director deems necessary for the effective administration and enforcement of this chapter.
§ ‑5 Penalties. Any person violating this chapter or the rules adopted pursuant to this chapter, shall be fined not more than $500."
SECTION 2. This Act shall take effect upon its approval.
