A BILL FOR AN ACT

 

 

RELATING TO CERTIFICATES OF CONVEYANCE.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 46, Hawaii Revised Statutes, is amended by adding a new section to be appropriately designated and to read as follows:

     "§46-    Short-term rentals; conveyance document or instrument.  Each county shall have the power to enact ordinances to require a grantor of real property to include in the conveyance document or instrument a statement specifying whether the county has determined that the real property may be used to conduct short-term rentals in accordance with the county's zoning or land use ordinances; provided that the ordinance enacted by the county pursuant to this section shall:

     (1)  Prescribe the form of the statement described in this section and any procedures for including the statement on the conveyance document or instrument; and

     (2)  Include a definition of "short-term rental"."

     SECTION 2.  Section 247-6, Hawaii Revised Statutes, is amended by amending subsection (c) to read as follows:

     "(c)  The form of the certificate and the procedure to be followed for the submission of the certificate shall be prescribed by the director[.]; provided that for any certificate under this section, the grantor, if required by an ordinance adopted by a county pursuant to section 46-   in which the real property is located, shall include a statement specifying whether the county has determined that the real property described in the conveyance document or instrument may be used to conduct short-term rentals in accordance with the county's zoning or land use ordinances."

     SECTION 3.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 4.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 5.  This Act shall take effect on January 1, 2050.

Allows counties to enact ordinances to require that a conveyance document, conveyance instrument, or certificate of conveyance include a statement indicating whether the county has determined that the real property described in the document, instrument, or certificate may be used for short-term rentals under the county's zoning or land use ordinances.  (SB3089 HD1)
