A BILL FOR AN ACT

 

 

relating to elections.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  The purpose of this Act is to authorize the elections commission to remove the chief election officer by a majority vote of a quorum at a meeting of the elections commission.  This Act also provides the chief election officer with a period of notice of the removal before the removal takes effect.

     SECTION 2.  Section 11-1.6, Hawaii Revised Statutes, is amended by amending subsection (g) to read as follows:

     "(g)  [The] Notwithstanding section 11-7(d), the chief election officer may be removed by the elections commission at any time [for good cause.] by a majority vote of a quorum at a meeting of the elections commission; provided that:

     (1)  The elections commission shall notify the chief election officer of the removal in writing, no later than seven business days following the affirmative vote to remove the chief election officer by the commission; and

     (2)  The removal shall not take effect until      days following the receipt of notice by the chief election officer pursuant to paragraph (1)."

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
