A BILL FOR AN ACT

 

 

RELATING TO LIMOUSINES.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Chapter 291C, Hawaii Revised Statutes, is amended by adding a new section to part XI to be appropriately designated and to read as follows:

     "§291C-     Limousine parking; restrictions.  (a)  It shall be unlawful for the operator of any limousine to park the limousine or to permit the limousine to be parked, stand, or remain motionless for a period in excess of four hours on any public roadway.

     (b)  Wherever parking stalls on any public roadway are established, marked off, and designated, the driver of any limousine shall park the motor vehicle completely within the designated stall.

     (c)  For purposes of this section:

     "Limousine" has the same meaning as in section 271-8.

     "Limousine operator" has the same meaning as in section 271-8."

     SECTION 2.  Section 271-8, Hawaii Revised Statutes, is amended to read as follows:

     "§271-8  Certificate or permit required.  (a)  Except as provided in section 271-5, no person shall engage in the transportation of persons or property, for compensation or hire, by motor vehicle, over any public highway of this State unless there is in force with respect to the person a certificate or permit issued by the [public utilities] commission authorizing the transportation.

     (b)  Upon application to renew a motor carrier certificate or permit for the operation of a limousine and prior to granting or denying the application, the commission shall consider the history of violations of section 291C-    or any other statute or ordinance governing stopping, standing, or parking on a public roadway issued to the carrier.  The commission shall adopt rules pursuant to chapter 91 to implement this subsection.

     (c)  For the purposes of this section:

     "Limousine" means a motor vehicle with a seating capacity of one to seven passengers used to transport passengers for a rate filed with the commission or as otherwise defined by the commission by rule adopted pursuant to chapter 91.

     "Limousine operator" means a person who operates or owns a limousine."

     SECTION 3.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
