STATE OF HAWAII

A BILL FOR AN ACT

 

 

RELATING TO THE IMPERSONATION OF A LAW ENFORCEMENT OFFICER.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 

     SECTION 1.  Section 710-1016.6, Hawaii Revised Statutes, is amended by amending subsection (1) to read as follows:

     "(1)  A person commits the offense of impersonating a law enforcement officer in the first degree if, with intent to deceive, the person pretends to be a law enforcement officer, [and] is armed with a firearm[.], and commits one or more of the following acts:

    (a)   Threatens violence to another person by an immediate show of force;

    (b)   Threatens or attempts to confiscate or damage property of another person; or

    (c)   Threatens or attempts to exercise dominion or control over another person."

     SECTION 2.  This Act does not affect rights and duties that matured, penalties that were incurred, and proceedings that were begun before its effective date.

     SECTION 3.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 4.  This Act shall take effect upon its approval.
