A BILL FOR AN ACT

 

 

RELATING TO THE HAWAII PUBLIC HOUSING AUTHORITY.

 

 

BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF HAWAII:

 


     SECTION 1.  Section 356D-4, Hawaii Revised Statutes, is amended by amending subsection (a) to read as follows:

     "(a)  The authority may:

     (1)  Sue and be sued;

     (2)  Have a seal and alter the same at pleasure;

     (3)  Make and execute contracts and other instruments necessary or convenient to the exercise of its powers; [and]

     (4)  Adopt bylaws and rules in accordance with chapter 91 for its organization, internal management, and to carry into effect its purposes, powers, and programs[.];

     (5)  Sell, lease, rent, hold, maintain, use, and operate any property, real, personal, or mixed, tangible or intangible, in support of its purposes, powers, and programs;

     (6)  Receive by gift, grant, devise, bequest, or otherwise from any source, any property, real, personal, or mixed, intangible or tangible, absolutely or in trust, to be used and disposed of, either the principal or the income thereof, for the benefit only of the residents assisted by its programs; provided that no gift to the authority that has an estimated value of $1,000 or more shall be accepted unless approved or confirmed by the board of directors; and

     (7)  Engage the services of volunteers as deemed appropriate by the authority without regard to chapter 76, 89, 90, 103, or 103D."

     SECTION 2.  Statutory material to be repealed is bracketed and stricken.  New statutory material is underscored.

     SECTION 3.  This Act shall take effect on July 1, 2050.


 


 

Report Title:

Hawaii Public Housing Authority; General Powers

 

Description:

Clarifies the power of the Hawaii public housing authority to sell, lease, rent, hold, maintain, use, and operate certain properties.  Authorizes the authority to receive all gifts provided they benefit public housing residents.  Requires that the acceptance of gifts with an estimated value of $1,000 or more be approved or confirmed by the board.  Authorizes the authority to use volunteer services.  Exempts the authority from various state laws for the use of volunteer services.  Effective 07/01/2050.  (SD1)
